The growth of ADR. The need for alternative dispute resolution services has been widely acknowledged and demonstrated by the legal profession’s acceptance of mediation as the preferred method of ending disputes, right behind direct negotiation, which, where feasible, is the best all around way to get the job done.
Obstacles in Negotiation. Often direct negotiation of an issue runs into such obstacles as lack of trust, widely different perceptions of what is fair, ethical or just, personality clashes, inequality of negotiating acumen, and a failure on one or both sides to appreciate fundamental interests and how best to realize or protect them. In such situations ADR providesr can engineer solutions.
Skills of Dave Finch. The skills of mediators such as Dave Finch are acquired and honed over time by training, continuing education and experience. (See C.V.) By providing a congenial setting, actively managing the process; stimulating communication and listening; caucussing with opposing parties; and persevering in the quest for solutions, Dave Finch has enabled the settlement of some of the toughest cases, achieving a resolution record of over ninety (90%) percent.
Arbitration. In the few instances where mediation has not worked, or where it is the perception of the parties that an adjudicated solution is necessary to end the dispute, arbitration is often the better alternative than court proceedings. The arbitration experience of Dave Finch is extensive and his work in this field has yielded resolutions consistently recognized by the parties as based upon a fairly administered process and a carefully thought out decision.
